Two men arrested in Ocean City are facing rape and assault charges in a case involving two minor victims, according to court documents.
Charging documents show a 911 call was made to Ocean City Police Communications at about 2:11 a.m. May 6 that was traced to the area of 127th Street and Coastal Highway. The caller told a dispatcher that she needed police before the call ended.
Another 911 call was made at about 2:52 a.m. and was traced to the area of 144th Street and Coastal Highway. Officers with the Fenwick Island Police Department found the caller, a 13-year-old girl, walking north on Route 1.
Police communications learned the 13-year-old was listed as missing through both the Montgomery County Police Department and the Concord Police Department in California, according to documents. She was also reported as “potentially a victim of human trafficking.”
Detectives interviewed the girl who told them she and a friend, who was a 14-year-old girl, had come to Ocean City with two men in their 20s who she knew as “Noah” and “David.” The 13-year-old also explained to detectives that the men had tried to have sex with the two girls and that one of the men had a machete in their hotel room, according to court documents.
The detectives met with the 14-year-old at the Comfort Inn Gold Coast, where she was found alone in a room. The girl agreed to be interviewed at police headquarters and told the detectives that she knew the men they had come to Ocean City with as “David” and “Tun Tun,” who were later identified as 22-year-old Bayron David Oviedo-Diaz and 24-year-old Onan Alberto Oviedo-Diaz, according to documents.
The 14-year-old explained she had sex with Bayron David Oviedo-Diaz on May 3 in their hotel room even though she didn’t want to because she felt obligated, documents state. She said he was aware of her age. A nurse later performed a sexual assault forensic examination on the victim at Atlantic General Hospital and found “evidence of sexual activity.”
The 14-year-old also disclosed that on the morning of May 6, Onan Alberto Oviedo-Diaz pulled out a machete and threatened to kill the 13-year-old if she didn’t have sex with him, according to documents. The girls fled the hotel room, walking north on Coastal Highway until they became separated before the state line.
Documents show detectives found Bayron David Oviedo-Diaz’s vehicle in the Comfort Inn Gold Coast’s parking lot and located a large knife in the trunk.
Both Bayron David Oviedo-Diaz and Onan Alberto Oviedo-Diaz, who are brothers, were later arrested at the hotel.
Charging documents state that during an interview, Bayron David Oviedo-Diaz admitted to having intercourse with the 14-year-old in a hotel room and acknowledged the machete was in his car, but denied his brother used it to threaten the victims.
Bayron David Oviedo-Diaz was charged with second-degree rape and second-degree assault, while Onan Alberto Oviedo-Diaz was charged with attempted first-degree rape, first-degree assault and second-degree rape and second-degree assault, according to online case records.
Both men were held without bond.
